Terms of Service

These terms explain the agreement between you and TrackQ when you create an account or use TrackQ Accounts, WatchQ, or FilmQ.

Please read before creating an account

By checking the agreement box and creating an account, you accept these Terms of Service, the Terms of Use, and acknowledge the Privacy Policy. If you do not agree, do not create or use an account.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you confirm that a parent or guardian has permitted your use. You must be legally able to enter this agreement.

2. Your TrackQ account

One TrackQ account can connect to multiple TrackQ apps. Give accurate information, protect your password and devices, and tell us promptly if you suspect unauthorized use. You are responsible for activity under your account unless applicable law says otherwise. You may revoke devices and app sessions from TrackQ Accounts.

You may not transfer, sell, impersonate, or create an account for another person without permission. Certain usernames are reserved to prevent impersonation and confusion.

3. What each service does

TrackQ Accounts

Provides shared identity, sign-in, security, profile, Catvatar, app connections, and deletion controls.

WatchQ

Helps you organize TV shows, episode progress, schedules, reactions, recommendations, notifications, and hidden content.

FilmQ

Helps you organize movies, watched history, reactions and notes, recommendations, blocks, and shared lists.

4. Your content and shared spaces

You keep ownership of text and other original content you submit, such as list names, notes, report details, and profile choices. You give TrackQ a non-exclusive, worldwide, royalty-free licence to host, copy, display, process, and transmit that content only as needed to operate, secure, and improve the Services and to show shared content to the people you choose.

Do not submit content you do not have the right to use. Shared-list content is visible to list members. Removing your account may not remove another member’s independent records or content that must remain to preserve a shared list, but we will remove or de-identify your account connection where reasonably possible.

5. Catalogue and schedule information

Movie and TV metadata, images, release dates, schedules, airtimes, recommendations, streaming availability, and provider links can be incomplete, delayed, or wrong. They may change without notice. Verify important release, cinema, broadcast, or subscription information with the official distributor or provider before relying on it.

TrackQ is independent. It is not endorsed or certified by TMDB, TVMaze, Watchmode, YouTube, streaming services, studios, broadcasters, TV Time, Letterboxd, or other referenced services. Names, images, and trademarks belong to their respective owners.

6. Notifications

Notifications are optional and depend on your settings, device, browser, network, stored schedule data, and third-party delivery systems. We cannot guarantee that an alert will arrive, arrive once, or arrive at a precise time. Do not rely on TrackQ notifications for emergencies or time-critical obligations.

7. Changes, availability, and beta features

We may add, change, suspend, or remove features to maintain security, comply with law, or improve the Services. We try to communicate material changes, but free features and third-party data can change without advance notice. The Services may occasionally be unavailable for maintenance, failures, or events outside our control.

8. Suspension and termination

You may stop using the Services, disconnect an app, or request account deletion. We may restrict or suspend access when reasonably necessary to investigate security issues, unlawful activity, serious or repeated rule violations, harm to other users, or risks to the Services. Where appropriate, we will give notice and an opportunity to address the issue.

9. Disclaimers

To the fullest extent allowed by law, the Services are provided “as is” and “as available.” We do not promise that the Services will always be uninterrupted, error-free, secure, or accurate, or that third-party catalogue or availability data will be complete. Nothing in these terms excludes warranties or rights that cannot legally be excluded under applicable consumer law.

10. Liability

To the fullest extent allowed by law, TrackQ will not be liable for indirect, incidental, special, consequential, or punitive loss, or for lost data, opportunity, goodwill, or profits arising from use of the Services, third-party data, or unavailable notifications. TrackQ remains responsible where liability cannot legally be limited, including liability caused by fraud, wilful misconduct, or other non-waivable obligations.

11. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. This choice does not remove mandatory consumer or privacy protections available in your province or territory. Disputes may be brought before a court with lawful jurisdiction.

12. Changes to these terms

We may update these terms when the Services or law changes. We will post the new effective date. For a material change, we will provide clear notice and request renewed acceptance where required. Continued use after a non-material update takes effect means you accept the updated terms.

13. General

If one provision is unenforceable, the remaining provisions continue. A delay in enforcing a provision is not a waiver. These terms, the Terms of Use, and the Privacy Policy form the agreement about the Services unless a specific feature presents additional terms.
